Terms of Service
These terms govern your use of diamondsafetytraining.com, every bundle site on a subdomain of it, trydiamondsafety.com, and the course catalog at training.diamondsafetytraining.com. Together we call these the Sites. They also govern the training you buy through us.
Read section 4 first. It explains who takes your payment, and the answer is not us: the charge on your statement will come from a company whose name is not on this page, which is worth knowing before it appears rather than after.
1. Who you are dealing with
Diamond Safety & Training, LLC is a Missouri limited liability company at 6921 E. 111th St., Suite 17780, Kansas City, MO 64134. Reach us at 888-339-8118 or info@diamondsafetytraining.com.
We are an independent safety training provider. That means we are not a government agency, we are not affiliated with the Occupational Safety and Health Administration, we hold no delegated authority from any regulator, and nothing on these Sites should be read as a statement by one. OSHA does not approve, certify or endorse online training providers or their courses. Nobody does.
2. Agreeing to these terms
Using the Sites means you accept these terms. Buying training means you accept them and the terms of sale in section 4. If you are accepting on behalf of an employer, you are telling us you have the authority to bind that employer, and "you" in these terms means both of you.
Don't use the Sites if you disagree with any of it.
3. Buyers, learners and what a learner needs
We sell in the United States only. Our buyers are United States employers, contractors and organizations purchasing training for their workers, and we do not offer these courses to buyers outside the country. Whoever accepts these terms or places an order must be at least 18 and able to enter a contract.
Learners are a separate question. Minors work, and a 16-year-old on a job site needs the training as much as anyone, so we do not bar a younger learner: the employer enrolling them is responsible for complying with the child labor rules that govern what that person may be asked to do, and those rules are not ours to administer. The Sites themselves are not directed to children and we do not knowingly collect information from anyone under 13.
A learner needs a working email address, a browser released in the last two years, and audio. System requirements are published on the platform described below and can change.
4. How a purchase actually works, and who takes your money
This is the part most terms pages bury, so it is early here instead.
Our courses run on the BIS Safety Software platform, often branded BISTrainer. When you click an enroll button on one of our Sites, you are handed to a store operated by BIS Safety Software Inc., and BIS is the merchant of record for that transaction. Your receipt will say "eCommerce transaction processed by BIS Safety Software Inc." Your card or bank statement will show a charge from BIS, not from Diamond Safety & Training, LLC.
That is expected. It is not a duplicate charge and it is not fraud. We say so here because a descriptor nobody recognizes is the single most common reason a legitimate charge gets disputed.
Your purchase is therefore subject to BIS's own terms and conditions and its privacy practices, in addition to these terms. BIS publishes those from the store footer as a single combined document.
That document does not state a refund window, a cancellation right, how long a seat lasts, or who the merchant of record is. We checked on 13 September 2026. That is the reason sections 5 through 8 exist and are this specific: for the terms that matter most to a buyer, this page may be the only place you can read them in one piece. Where BIS's terms govern the sale and ours govern the Sites and the relationship with us, both apply to their own subject. If the two ever conflict on the mechanics of a purchase, refund or platform account, BIS's terms control that question, because BIS is the party you bought from.
Sections 5 through 8 describe the sale terms BIS confirmed to us in writing on 27 August 2026. We publish them because a buyer should know the refund window, the seat clock and the name on the receipt before paying rather than after. They remain BIS's terms. BIS may change them, so treat BIS's published version as authoritative.
5. Prices, currency and tax
Prices shown on our Sites are per learner in United States dollars. Every one of them. Bundle prices are the sum of the courses in the bundle.
Tax is BIS's to calculate and is applied at checkout. The amount shown there, on the BIS store, is the amount you will be charged, and it governs over any figure on our Sites.
The BIS platform serves buyers in other countries and can present other currencies. That is not an offer we make. Our bundles are sold to United States buyers, and a price on our Sites is a United States dollar price.
We update prices when the platform's prices change. A price quoted in an email, a proposal or a conversation holds for 30 days unless we wrote a different date on it.
6. Refunds
Refund requests are accepted up to 90 calendar days following the date of purchase. Approved refunds are credited to the payment method originally used.
Two things follow from that and both matter.
Past 90 days, a refund is not automatic. BIS's accounting team reviews the request and may decline it.
If the learner has already completed the course, refunding it invalidates the certificate and removes the completion record. You cannot keep the credential and take the money back. If you are refunding a seat for someone who finished the training, understand that you are also giving up the proof that they took it.
Start a refund request with us at info@diamondsafetytraining.com or 888-339-8118, and include the order details. Depending on timing, we either process it directly or pass it to BIS.
7. The clock on a purchased seat
A seat purchased through the store is valid for 5 years from the date of purchase. After that it expires and is no longer redeemable.
Buy for the headcount you expect. Seats bought against growth that never arrives still carry a clock, and five years is long enough that nobody remembers being told, which is exactly why it is written here rather than left to a sales conversation.
8. Moving a seat to a different learner
A seat that has not been started can be reassigned to another learner. Ask us and we will do it, or your platform administrator can.
Once a learner has begun a course, treat that seat as spent. Reassignment of a started seat is not something we can promise.
9. What a certificate is
A completion certificate is dated evidence that a named learner completed a named course on a named day. The course publisher issues it, delivered through the BIS Safety Software platform.
Diamond Safety & Training, LLC does not issue certificates. We assemble courses into bundles, we sell them, and we support you through the training, and the credential at the end carries the publisher's name rather than ours because the publisher is who stands behind the content.
It is not a license. It is not a permit, a card issued by OSHA, or a finding by any regulator that you comply with anything. Several of the standards our courses address require periodic retraining, and some certificates carry their own expiry. Where a course page states an expiry, that expiry applies.
10. Where the training stops and the employer's duties begin
Our courses are written to address the training requirements of the standards named on each course and bundle page. Online delivery satisfies knowledge-level elements. That is a real part of what most standards require, and it is not all of it.
It does not satisfy everything a standard asks of an employer. Depending on the standard, the employer keeps responsibility for practical or hands-on evaluation of the operator, written programs and plans, hazard assessments and their certifications, equipment-specific and site-specific instruction, medical surveillance and exposure monitoring, recordkeeping, and the qualification determinations only a person who watches the work can make. Each bundle page describes the ones that apply to it. Read that section before you assume a course closes a gap.
State plan requirements are sometimes more stringent than federal OSHA's, and several states set their own cadence, content and credentialing rules. Confirm what applies where your people work.
11. Nothing here is legal advice
We are a training company. Content on the Sites and inside the courses is provided for training purposes, and it is not legal advice, not a legal opinion, and not a guarantee that you comply with any standard, statute or regulation.
Regulatory references on the Sites were verified on the dates stated beside them. Requirements change. Nobody at Diamond is your lawyer, and an inspector is not bound by anything we told you.
12. Using your account and your seats honestly
One seat covers one learner. Do not share logins, do not have one person take a course on another person's behalf, and do not resell or sublicense seats without our written agreement.
You are responsible for what happens under your platform credentials. If you think they have been compromised, tell us. We would rather reset an account for nothing than find out about a shared login when a certificate is challenged.
Do not scrape, crawl, mirror or bulk-download the Sites; interfere with their operation or security; or use them to send anything unlawful, misleading or harmful. Automated access outside a published robots.txt allowance is not permitted.
Falsifying a completion, or presenting a certificate for training a person did not take, costs you the credential. BIS's own terms provide that where a platform account is misused to complete an online course, the completion and any related certificate are voided at the user's cost, with no refund or credit. We will report it and we will not argue you out of that outcome.
13. Content, and who owns it
The copy, photography, page design, compliance mapping tables, guides and other material we publish belong to Diamond Safety & Training, LLC or to the people we licensed them from, and course content belongs to the publishers who produced it. Our name, logo and bundle names are our marks.
You may read, print and share our public pages for your own evaluation. You may not republish them, sell them, feed them to a model as training data, or use them to build a competing offering.
Downloadable guides are licensed to you and your organization for internal use. Keep our attribution on them.
14. Email, phone and how we contact you
Ask us for a quote and you are asking us to reply, by email or phone, about that request. Download a gated guide and you get that guide. Those are the consents the forms describe. We honor them as written, and we do not treat a quote request as permission to add you to a marketing list.
We also run an outreach email program. Every message in it carries a working one-click unsubscribe and our postal address, and an unsubscribe is processed promptly. Unsubscribing from marketing does not stop transactional messages about an order, an account or a refund, because those are not marketing.
To reach a person about any of this, write to info@diamondsafetytraining.com.
15. Links and services we do not run
The Sites link to OSHA and other government publications, to the BIS store, and to other third-party resources. We do not control those and we are not responsible for their content, availability or practices. A link is not an endorsement. When you leave our Sites, the other party's terms and privacy policy apply.
16. Availability
We work to keep the Sites and the platform up. We do not promise they always will be. Maintenance happens. Third-party platforms have outages, and we may change or discontinue any part of the Sites, which is an ordinary thing for a business to reserve and not a license to strand a customer who has paid. Where a course you paid for becomes unavailable through no fault of yours, contact us. We will substitute equivalent training or arrange a refund under section 6.
17. Warranties
The Sites and their content are provided as they are. To the fullest extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that the Sites will be uninterrupted, error-free or free of harmful components.
We do warrant the thing that matters: we describe our training accurately. If a course or bundle page misstates what a course covers, tell us. We will correct the page, and where you bought that training in reliance on the misstatement we will arrange a refund under section 6 or substitute equivalent training, at your choice. That is the remedy for this warranty, and it is the whole of it.
18. Limits on what we owe if something goes wrong
To the fullest extent the law allows, Diamond Safety & Training, LLC is not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost business, lost data, regulatory penalties, or the cost of substitute services, even if we were told such damages were possible.
Our total liability arising out of or relating to these terms or the Sites will not exceed the amount paid for the training at issue in the 12 months before the claim arose, whether that amount was paid to us or to BIS Safety Software Inc. as merchant of record for a purchase made through the Sites. We say it that way on purpose. Section 4 explains that BIS takes the payment, so a cap written against money paid "to us" would cap most claims at nothing, and a cap of nothing is not a limit a court is likely to respect.
Some states do not allow some of these exclusions. Where that is so, they do not apply to you, and nothing here limits liability for fraud, willful misconduct, or anything else that cannot be limited by law.
19. Indemnity
You will defend and indemnify us against claims arising from your misuse of the Sites, your breach of these terms, or your violation of a law or a third party's rights. We will tell you promptly about any claim and let you control the defense of it, and we will cooperate with you.
20. Governing law, and where a dispute is heard
Missouri law governs these terms and any dispute arising from them, without regard to conflict-of-law rules. The state and federal courts serving Jackson County, Missouri have exclusive jurisdiction, and both of us consent to venue there.
21. Changing these terms
We may update these terms. The effective date at the top changes when we do, and the version posted here is the one that applies. Material changes get notice on the Sites. Continuing to use the Sites after a change means you accept the updated terms.
Your purchase is governed by the terms in effect on the day you bought.
22. Odds and ends
If a court finds part of these terms unenforceable, the rest stays in force. Our failure to enforce something is not a waiver of it. You may not assign these terms without our written consent; we may assign them in a merger, acquisition or sale of assets. These terms, the privacy policy, and any signed agreement between us are the whole agreement about their subject.
Nothing here creates a partnership, an agency, or an employment relationship between us.
23. Notices
Legal notice to us goes to Diamond Safety & Training, LLC, 6921 E. 111th St., Suite 17780, Kansas City, MO 64134, with a copy to info@diamondsafetytraining.com. Notice to you goes to whichever email address is on your order or your quote request, and either kind of notice takes effect when it is sent rather than when it is opened. Keep that address current, because a notice sent to an abandoned inbox still counts as given.
24. Things outside anyone's control
Neither of us is liable for failing to perform because of something neither of us controls: a natural disaster, war, civil unrest, labor action, epidemic, government action, a failure of the internet or of a telecommunications network, or an outage at a platform provider we depend on. This does not excuse paying money already owed, and it does not excuse us from the refund and substitution remedies in sections 6, 16 and 17.
